The Constitutional Declaration, whosedocument was released by the Bahraini national opposition in a press conference on Thursday, November 10, 2022 in London, stressed that it is the culmination of the decades-long struggle of the people of Bahrain for their right to self determination.
The ‘’Constitutional Declaration’’ document included the most important foundations and premises that represent a national roadmap, and express a political vision that is widely accepted by the people and their vital forces, and is a basis and pillar for the continuation of the national revolutionary march to address the state of political obstruction persistent in our dear homeland, as follows:
Article 1: The illegality of the 2002 constitution, which was unilaterally issued by the Ruler of Bahrain and in excess of all the consensuses concluded between the loyal leaders of the people and the symbols of the regime, and as constitution issued with a dangerous legal override of the 1973 Constitution, which contained in Article (104), paragraph (a), how the constitution is amended.
Article 2: Not to recognize all the results of the 2002 constitution, including the sham elections, considering them lacking constitutional, legal and popular legitimacy, and should be boycotted and not dealt with in any way that gives them legitimacy.
Article 3: According to a new transitional phase the national forces continue with the people to work in order to prepare the perfect conditions for holding elections of a Constitution Assembly according to a fair division of electoral districts, provided that native citizens exclusively participate in the elections – under independent local and international supervision – and the task of the Council is to manage the transitional phase and to draft a new constitution for Bahrain in line with the aspirations of our dear Muslims people.
Article 4: The new constitution will be definitively ratified or rejected by a free plebiscite in which native citizens participate exclusively, and under independent local and international supervision.
Article 5: In case, the results of the popular referendum result in the people’s rejection of the new constitution, the Constituent Assembly shall make amendments that are compatible with the culture and aspirations of our Muslim people, after which an amended version of the constitution shall be submitted to a popular referendum again.
Article 6: The results of the Constituent Assembly elections and the results of the popular referendum on the new constitution shall be binding on all parties, and the new constitution will have a binding force that supersedes the previous constitutions.
The Opposition explained that this document represents the basic controls to which it is committed before the people of Bahrain, and it is a declaration of the quest to renew and develop the constitutional movement launched by our ancestors and fathers in order to establish a free and dignified state, governed by a democratic constitution in accordance with Islamic law, and in line with the aspirations and sacrifices of this great people.
